These Terms of Service govern your access to and use of Evolve University, a learning, community, and accountability platform operated by Evolving Legacy LLC, doing business as Evolve University (“Evolve University,” “we,” or “us”). By creating an account or using the platform, you agree to these terms. If you do not agree, do not use the platform.
1. Who we are, eligibility, and your account
Evolve University is an education and software business operated by Evolving Legacy LLC, doing business as Evolve University. It is not a real estate brokerage, is not affiliated with any brokerage, and does not give legal, tax or brokerage advice. Your own brokerage, state and counsel govern your practice.
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information and for keeping your password secure. Accounts are for a single person and may not be shared. You are responsible for all activity under your account.
2. Membership plans and billing
Paid memberships are recurring subscriptions billed in advance through our payment processor, Stripe. The plans we sell are:
- Tools (monthly) and Tools Annual
- Pro (monthly) and Pro Annual
- Operator (monthly) and Operator Annual
- Inner Circle (monthly)
The plan name, price, and billing interval are shown at checkout before you pay. By subscribing you authorize us to charge your payment method on each renewal at the then-current price until you cancel. Monthly plans renew monthly and annual plans renew yearly.
Annual plans. Tools Annual, Pro Annual, and Operator Annual renew automatically for another year on the renewal date shown on your billing page, which is one year after your purchase or your last renewal. We email you a reminder 30 to 60 days before each annual renewal that states the renewal date, the price, and how to cancel. To stop the renewal, cancel in Manage Billing on your billing page before the renewal date. Your access then continues through the end of the year you have already paid for.
You may cancel at any time from your billing page. Cancellation stops future renewals; your access continues through the end of the period you have already paid for. We may change plan prices with at least 30 days advance notice by email, and any change applies only to your next renewal. Prices are exclusive of applicable taxes, which may be added at checkout.
3. One-time purchases
Some items (templates, practice packs, the certification exam, and printable tools) are sold as one-time purchases. On completed payment you receive access to that item on your account. Downloadable items are delivered as files you may download for your own use.
4. License to use content
We grant you a personal, limited, non-exclusive, non-transferable license to access and use the courses, materials, downloads, and tools for your own professional use. You may not copy, resell, sublicense, publicly distribute, or share your access or the materials with others. Certifications and badges represent completion of the stated requirements and may be verified through our public verification page.
5. Your content and conduct
You retain ownership of what you post in the community. By posting, you grant us a non-exclusive license to display and distribute it within the platform as needed to operate the service. You agree not to post anything unlawful, harassing, misleading, or that infringes another person’s rights, and not to misuse the platform (for example, by scraping, reverse engineering, circumventing access controls, or overloading the service).
6. AI features
The platform includes AI role-play, coaching, and tools. Their output is generated automatically, may be inaccurate or incomplete, and is provided for practice and assistance only. It is not professional, legal, tax, financial, or real estate advice. Do not rely on it as advice; check it yourself, and you are responsible for your own decisions and for anything you send to a client or publish.
Plans that include the member tools allow 200 tool and workflow runs per member in any 30 day period. Each step of a multi-step workflow counts as one run. We may change this allowance, and we may limit or pause AI features to keep the service available and to control cost.
7. No guarantee of results
Evolve University provides education and tools. We do not guarantee any particular business, income, or professional result. Outcomes depend on many factors outside our control, including your own effort and your market.
8. Third-party services
We rely on third parties to operate, including Stripe for payments, and other providers for email, hosting, and content delivery. Your use of the platform may be subject to their terms. We do not store your full payment card details; those are handled by Stripe.
9. Termination
You may stop using the platform and cancel your membership at any time. We may suspend or terminate your account if you violate these terms or use the platform in a way that harms us or other members. On termination, your license to the materials ends.
10. Disclaimers and limitation of liability
The platform is provided “as is” without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Evolving Legacy LLC will not be liable for any indirect, incidental, or consequential damages, and our total liability for any claim relating to the platform will not exceed the amount you paid us in the twelve months before the claim.
11. Changes to these terms
We may update these terms. If we make material changes, we will update the effective date above and, where appropriate, notify you. Continued use after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Florida.
